Legal Question in Family Law in New Mexico

my 13 year old son flew up to concreate wa. for the holidays from albuquerque New Mexico,my x wife the mother is refusing to send my and her son,back to albuquerque.I am the father have full Physical custody.....

First, take your court order and go to the nearest police station and fill out a police report. (They may want a copy of your court order so make several copies that way you can leave a copy with anyone who would like or need one). Second, contact the district attorney's office and ask them to help you get your child back. Third, either contact an attorney or on your own file an 'emergency motion for return of child." (I am assuming your court order giving you custody is from a state of New Mexico court. If your court order is NOT from the state of New Mexico then you should definitely see an attorney. If you cannot afford an attorney go talk to Legal Aid or call NM Law Access). Fourth, call the FBI and report the kidnapping crime that you are alleging. In my experience with the district attorney's office in Albuquerque a very high percentage of these type of cases are resolved after a telephone call from the district attorney's office. However, following through with the other steps I have set forth above will help assure your child is returned to you.
