How do I change my last name back to my maiden name legally without getting a divorce? I am recently married and I originally took my husbands last name but after discussing it with him I would like to change it back to my maiden name. I have no intertion of getting a divorce.

The law on how to achieve a Change of Name is under chapter 40, article 8, sections 1 - 3.

Also, at the first judicial district court

http://www.firstdistrictcourt.com/Name Change Forms.htm

you can find forms that you can download and fill in to use in your judicial district.

This is not a difficult task to achieve on your own. Of course, lawyers always make navigating the legal system a little easier, but you can do this on your own with a little bit of persistence.

Below is the outline of the name change law; you can search for these statutes online or they should also be at your local library.

ARTICLE 8

Section

40-8-1 Change of name; petition and order.

40-8-2 Notice of petition; exception.

40-8-3 Hearing at regular term in county of petitioner's residence.

40-8-1. Change of name; petition and order. (1989)

Hope this helps.
