Legal Question in Family Law in New Mexico

Child Custody

We have a child that we feel is in immediate danger living with her custodial parent. We have visited every avenue we can think of and cannot get the children out of this situation. What are the legal processes for removing them?

Re: Child Custody

You are required by law to report to the police or to the Children YOuth and Families Department - Child Protective Services Division if you believe the child is being abused or neglected.

If CYFD fails to act you can file a petition yourself but you have to go through the Children's Court Attorney under statute 32A-4-15. Call the local District Attorney's office to find the Children's Court attorney in your district.

Get an attorney - if you can't afford one try to get help from Law Access New Mexico at 18003409771.
