Legal Question in Family Law in New Mexico

can you get a child custody "modification" without an attorney? In my custody papers it stated if after certain aspects were met, and things were better for myself and the children, one of the parents could request a modification of custody. What sorts of things should I be aware of before filing for modification? Can this be done without an attorney n my behalf? If so, could it hurt my case?

You have asked the Guru a broad theoretical question with no specific information about your particular case. The answer, necessarily, will also have to be broad. People who file on their own and without representation are identified by the term "pro se." And, anyone can represent themselves in a custody modification action. There are so many things one should be aware of before filing for modification that the question cannot be reasonably answered here. You should bring these questions to an attorney and discuss your case with an attorney. You can hire an attorney to perform a limited representation of you so that you can keep your costs down and you can have a proper filing before the court. Ask your attorney about limited representation.
