The very LEGAL and SHORT answer to your question is that children do not get to determine who they live with or when they live with that person. However, beginning at age 14 a child gets to express his or her opinion whom he or she would like to live with and at that age a judge can take into consideration the wishes of the child. Regardless of the child's wishes parents and judges make the decision as to whom a child lives with in New Mexico. Children themselves have very little to nothing to do with such decisions.
Hope this helps.
