Legal Question in Family Law in New Mexico
child support enforcement
My ex wife was ordered by the court to pay child support in 1997. I have had custody of our 2 childre since then. She remarried and and had 2 other children who are now 4 and 1 year and a half. She voluntarily quit her job and stopped paying the court ordered support in 2003. I have not received anything from her since then. I have had a case with the state since that day she quit her job and she has constantly ignored their letters and phone calls. The only thing I receive is the tax intercepts from the state. The state also said I could use any documents they have if I need them. She now owes 20,500.00 in back pay. I have filed and am taking her to court myself as soon as judge Driggers gives us a court date. In her response, she states that she doesnt have to work or pay because she is raising 2 kids under the age of six and she also says she shouldnt be held in contempt of court ''due to failure of filing a motion'', by me. I am assuming she means, I have never asked for the child support. She also wants primary custody now. She is going Pro-Se. Our kids are 11 and 8,does she not have to work or pay because of HER 2 kids that are under 6? Are any of her statements or requests valid?
