Legal Question in Family Law in New Mexico

Child Support and Remarriage

My boyfriend, who pays child support, and I are to be married and we realize that in Texas my income is not considered in the child support calculation, however in New Mexico, where the divorce decree occurred, will my income be included in the child support calculation due to our marriage in the short future?

Re: Child Support and Remarriage

In a word, "no." New Mexico does not consider the income of the subsequent spouse in the calculation of child support as between the custodial and non-custodial parent. The statute citation (which states this part of the law and which you should be able to find at http://www.nmcourts.com ) is something like 40-4A-11.1 (I may be off on the .1).

Good Luck in your upcoming marriage.
