Legal Question in Family Law in New Mexico

My childrens well-being

My ex and I are divorced. She lives in NM and I live in TX. I have had my kids for a month this summer and have to take them back to her this weekend. My kids are refusing to go back because of the way they are treated at her house. They are 12, 9, and 2. My 2 oldest are constantly complaining about how their mother lays in bed all day and they have to care for the 2 year old from breakfast to dinner on a daily basis. Their mom claims to have MS and is supposedly drawing disability and food stamps from the SSI and the state of NM. Do I have any legal grounds to file a restraining order against her for how she treats the kids? If so, my son is willing to give a statement on everything and we are willing to travel to NM to get this done.

Your inquiry suggests that the orders are in NM. If you want to assert what you're saying, you'll have to do it NM. Certainly, the 12-year old's testimony would be valuable. If you're going to help him, get started in NM.
