Legal Question in Family Law in New Mexico

How can I get custody of my grandson? He is 3 years old and the mother is in and out of jail, a drug addict and her family has my grandson for 6 months but they keep giving my grandson back to his mother and she just was caught by the police selling drugs with my grandson in the vehicle. The father of my grandson is my son and he is the one who has been taking care of my grandson, both of them live with me. My son didn't pass a drug test so the grandmother of the mother has temp custody until October 2016. Please call me at (505)-920-1880. Thank you.

I left a message for you. Have you reported the situation to CYFD as child abuse or child neglect? They can do an investigation and they can take the child. When they take the child they must first consider placing him with a relative, and you can ask for custody but they'll also consider other relatives in a rather complicated process. Nevertheless you may be their best bet. If I were you I would start there.
