Legal Question in Family Law in New Mexico

My daughter is 14 yrs old. I have raised her all 14 yrs. Her dad was in prison for about 8-10 yrs. Got out in 2008. Lives in New Jersey. Well she wants to go live w him. Do we have to sign any custody papers? Is that a bad idea?
