Legal Question in Family Law in New Mexico
if there was a divorce between two people and joint physical and legal custody was granted to both parties and now one wants to move to another town can he or she take the parties children if the one party says no?

The parenting plan has to be changed to accommodate the changed circumstances. Neither of you can do anything with the kids that is not in the parenting plan unless the other agrees. You can negotiate a new plan and present it to the court for approval, or if you don't agree one of you can petition the court for a new plan and the court will likely appoint a mediator to help you work it out.
