Legal Question in Family Law in New Mexico

Divorce Settlement

My soon to be ex has agreed on a settlement. He is going to buy me out of a construction business and our homes and property. What is the best way to secure that he pays me? Both homes are mortgaged one has some equity but not clear easement. (The easement is through the main house property)

Re: Divorce Settlement

This is one of the most surprising questions I have ever seen on this bulletin board during the past 8 years. You cannot get a sufficient answer to this type of question in the limited space that is allowed herein. Go and get a lawyer immediately, if not sooner! I will assume that you are talking about property values near or in excess of a quarter million dollars. It is ludicrous to think that you can close a deal on that much property value and not have a lawyer reviewing and offering advice. I can think of several lawyers in your town that I know personally (and who you may know also) who could provide you with several options and ranges of ideas to secure the payments you seek from your soon to be ex. Additionally, there is a 'new' kind of divorce practice that some lawyers are using called "collaborative divorce." If you go to www.nmcollaborativedivorce.com you will find a whole list of attorneys who are near you who can answer all your questions and help you achieve peace of mind during this roller coaster ride you are on.

Go see a lawyer. Please.

Good luck.
