Legal Question in Family Law in New Mexico

My fianc� has to go to court for a battery charge on a household member. His son went after him with a knife and out of self-defense he tried to hit him. The judge is aware of the potential stabbing. My fianc� wants to move an hour and half away from the town where this happened. Can he do this or will the judge order him to stay in that town?
