Legal Question in Family Law in New Mexico

I need to know what forms to file in a child custody and child support case. My ex wife has custodial custody of our 16 year old daughter and has abandoned her. She has been with me for 2 weeks now with no contact from her mother and her mother is keeping the child support.

I would file an Emergency Motion to Change the Parenting Plan and the Child Support Order. You also file a request for hearing and a blank order for the judge to sign granting a hearing. All these have to be served on your ex. I don't see a form for the Motion on line but the link above gives you access to the on-line forms for domestic relations, and a nearby page will give you forms for the request for hearing etc.If in doubt go to nmcourts.gov and click on legal forms/domestic relations. Don't go to the family forms link. There you can find a form for a parenting plan and child support order which you can. You must continue to pay the child support until a new order is filed, but you can ask for it to be refunded to you retroactive to the day you started caring for your daughter.
