Legal Question in Family Law in New Mexico

I have full physical and joint legal custody of my 16 yr old daughter. I re-married and my husband has been assigned a job in another state. My daughter does not want to go to the new state but cannot stay in the current state with her birth father due to abuse. Is it legal for her to stay in the current state alone??

She may live on her own in New Mexico beginning at age 14.
