Legal Question in Family Law in New Mexico
My ex husband and I were divorced in the state of New Mexico a little over a year ago. During the separation of property, he was given the family car and it is written in the papers. The car was registered to me and my name is on the loan. I have asked him countless times to refinance the loan and re-register the car. He continually refuses to do so claiming he will get around to it on his own time. I want to buy a new car for myself and the loan will show that I have too much financial obligation when Im not even paying it or responsible for it. I want him court ordered to do these things and have been told I need to reopen my divorce case. I am also interested in seeking a restraining order to where he cannot email or text or call or have a 3rd party do so because when I ask him nicely to do these things he just cusses me out and calls me names and belittles me. If you are able to offer advice please let me know.

There is a legal procedure call "order to show cause." An Order to Show Cause is a procedure whereby you bring to the court's attention that someone is violating an order of the court and that you are harmed by virtue of their acts or (in this case) failure to act. You then ask the court to impose a "sentence" on the person. The sentence is usually punitive.
You can go to your local courthouse and see if they have a self help center as they may be able to help you. You can also call "NM Law Access" as they answer questions over the telephone. You could also go to the web page for the 1st Judicial District or the 13th Judicial District and see if they have the forms on their website.
