Legal Question in Family Law in New Mexico

My former husband left me a money on a bank account, and exactly-included my name equally with his name.I knew it subsequent to his death and took off a money.Now his son tries to take away these money for me.He talks that I am a former wife and does not have rights on these money.Is it possible by the legal way?My husband did not leave a testament.
