Legal Question in Family Law in New Mexico

My husband and I are wanting to relocate, in state, for better job oppurtunities. It is over 100 miles away from where we live now. My ex and I are both wanting to have our son during the school year. What are my chances of being awarded custody of him during the school year? We both have joint custody and see him equally.

Up to the judge. Judge will consider the best interests of the child - if the child is over 13 the judge will consider what the child wants as well. Factors would be the movement from his current surroundings, the relative stability of the two households. There is probably a bias in favor of leaving the child in his/her current school, all else being equal.
