ex husband's creditors now after my daughter

My daughter has been divorced for 8 years. Divorce took place in New Mexico. Her husband got trailor, she got her car and was to get $2,000. She moved home to Indiana. He filed bancrupsy. She got nothing. Now (8 years later) financial institute has forclosed on, taken possession of and sold the trailor. They are calling her and say they are coming after her for balance of the original debt. Can they do this when Judge ruled the tailor was his?

Your daughter is stuck. The ruling was a division of debts between your daughter and her husband at the time. The company was not a party to the divorce and did not agree that they would only collect from him.

I will agree in general with the other attorney's response. However, I would further qualify the answer to say that your daughter should have an attorney review the divorce decree and check the order and see how it was written. Additionally, any attorney is going to want more detailed information than the few sentences you are allowed when posting to this bulletin board. Without seeing the document none of us can definatively say she is foreclosed from *any* remedy at all in this matter.
