Legal Question in Family Law in New Mexico

I Have joint physical custody my ex has not paid child support in the Last 9 months and has only came 3 visits out of 9 and thats not included all the holidays missed then moved to Texas which is 8 hrs from where my son and I live, and she has not told my 11 year old about the move is it possible that I could get sole legal custody of him

All things are possible but it's not likely you could get sole legal custody. I don't know what type of custody you have now but you certainly could ask for sole physical custody.

Have you filed an order to show cause to get the back child support? You can get a judgment and a garnishment order. If you are on any kind of assistance you can ask CSED (Child Support Enforcement Division) to get go after him for child support.
