i have been living with the mother of my daughter for 2.5 years we are not married and things are not going well i want to go back to school and finish my degree but she has threatend to take my daughter from me can she do that when she has no job or means of providing for my daughter i am the head of house hold

You haven't said whether or not you have ever established your paternity of the child. I would suggest one way to do this would be to file a petition to establish paternity. You can find a packet of forms for this with instructions here: http://firstdistrictcourt.com/Forms/doc/parentagepacket.doc

This packet is for the first judicial district. Your district may have a packet at the courthouse if you ask, otherwise you could just change the heading on this for your judicial district. The process this pleading initiates determines paternity, child support, and custody.
