Legal Question in Family Law in New Mexico
How long after getting a divorce do you have to wait to go back to court to change the custody and child support in the state of New Mexico?
1 Answer from Attorneys
When you have a change in circumstances materially affecting the best interests of the child (or the health, safety and welfare of the child) you can file a motion to change either custody or child support. Thus, for example, you go to court and get a child support order on Tuesday. On Wednesday you buy a lottery ticket and win millions. You could file a motion on Thursday to change child support. Similarly, if you find out that the other parent is doing something resulting in harm to your child there is no law that would prevent you from filing a motion immediately to make changes to your parenting plan or to the custody of the child.
Good luck.
