If a marraige to a Mexican National is legal

I need to find out if a marraige to a Mexican National is legal if they are illegal and do not have a social security number or even a Visa.

The question you pose is not real clear. I will assume you are asking that if a person who is a citizen of Mexico is living in the United States but is here illegally and they got married to a citizen from the United States is that marriage legal? My initial impression is 'why yes, of course!'

I am not sure, but I would believe, that marriage itself is not restricted by the place where the marriage occurred. That is to say, so long as the people who got married could get married then it does not matter where they got married. The fact that one, or both, are not citizens of the country wherein the marriage took place, is likely immaterial to the issue of whether the marriage is legal or not.

However, by visiting with an attorney you would have to look at issues such as the ages of the parties when they got married; were they both sober sufficiently to know what they were doing; and there are other questions that an attorney would ask just to see that all the laws were followed.

A very specific answer to your question can be obtained by visiting with a family law attorney. You can find a family law attorney in New Mexico by looking in the yellow pages of the town or city where you live; or, you could ask friends or family for the name of an attorney who they believe they were happy with after their legal action was completed; or, you can also look at the New Mexico state bar web site at http://www.nmbar.org and look for information about the 'attorney referral program.'
