Legal Question in Family Law in New Mexico

I was married and left my second husband after 1 year because of abuse, He told me he filed an abondenment divorce against me. Five years later I remarried again. We were dating and married for 14 years. I went to divorce him and found out my 2nd husband never file divorce as he said. 1st question is what is the status of my 3rd marrriage since i was still married to the 2nd one . the judge said she there would be no divorce to grant if I was still married to # 2. 2nd question what do i have to do to get out of the 3rd marriage if no divorce can be granted or is it just void and like it never happened. I live in New mexico

1. You can still get a divorce from husband #2. 2. Your marriage to husband #3 is void, and a NM court will entertain a petition, similar to a divorce in some ways, to declare the marriage void. When that is done, you have no ties to #3. You should obtain a court order, however, in order to prove your marital status in the future.
