Legal Question in Family Law in New Mexico

Modifying Alimony amount after Final Decree

I was divorced in NM and now live in Texas. I have to pay $1600/mo alimony. My ex just inherited a few hundred thousand dollars, her parents estate included a house, car and a trust and was split in half by two siblings. Can I request to have the alimony requirement eliminated or reduced and do I have to do this in a NM court (she still lives in NM)? My income has increased since the final decree at a higher rate than her income. If I make the request, could it backfire on me and possibly require me to pay more than I do now? Please advise.

Thank you!

Re: Modifying Alimony amount after Final Decree

NM has something on the order of 7 different kinds of alimony. You did not say what kind or what type you are ordered to pay. As Mr. Williams said, 'you need to consult with an attorney in NM' and that point cannot be over-emphasized.

If you do not know an attorney you can goto the state bar web site http://www.nmbar.org and use their attorney referral service (they also have an 800 number you can call); or, you can look both on the internet (generally) or in the telephone book yellow pages for the city/town or county where you obtained your court order.

Good Luck.
