Legal Question in Family Law in New Mexico

I was divorced in oct of 2002 in the divorce my x wife got the house My guestion is how do i get my name off the mortage papers I guick clamed the house over to her. I want to buy a house in the furture. but i may not be able to with my name on another loan. She cant refi because of her finances, and she does not want to sell the house. Help

Your assessment of not being sure you'll be able to buy another house in the future while your name is still on the loan for your former house is correct. You have several options available to you but your primary goal is to get your name removed from the loan. Unfornately, I will not be able go into each option because the nature of your inquiry is such that an attorney would have to ask involved and in depth questions about your divorce, your financial situation and your former spouses financial situation. Such an interaction cannot occur in the setting of an online forum.

As you may know the state bar of New Mexico has an attorney referral program that you may access via the state bar's website at http://www.nmbar.org - also you should be able to find an attorney in the yellow pages in the town or city nearest where you live. Last, if you have not had an attorney in the past help with this issue ask friends and family for a referral to a family law attorney or an attorney with knowledge about commercial transactions. While (I believe) an attorney with knowledge about commercial transactions may be able to help with pure information about your situation an attorney who works in the family law area will generally have more experience with your specific question area and will likely be able to provide to you a realistic approach in resolving this delimma.
