Legal Question in Family Law in New Mexico

NCP threatens to live the country so that his income is substantially less

There is a court order to pay 600$ in child support. The father just notified me that he is leaving US and going to Mexica where cost of living are less then in NY and his income will be less and he will have to pay C/S 100$ based on his declared income in the future. My question:

1. will a court adjust the C/S in this case?

2. Can he just dissappear at all(he is a US sitizen, and will return to the country at some point but can hide from me after the return-now I know everything about him)

3. What should I do to protect my rights in this case?

The CS is based on his abliity to earn.

That has already been established. He will not get a downward modification, but your problem will be in ENFORCING the existing order.

Suggest your attorney try to attach any assets that can be used as security for the payment of CS.
