yes my nephew was taking a way by CYFD and he well not be going back to him home but me & my husband are willing to take he in but was told that we did not report that there was something going on in his home that we can not get him but if we wont to become foster parents we need to do that but we are willing to take him in what can we do should we get a lawyer

You should talk to a lawyer for sure. If the child has been taken into custody by CYFD there has to be a custody hearing within ten days, and you should go to that. Petition the court in writing for custody of the child. If you can afford a lawyer, then by all means get the lawyer. CYFD may argue to the court hat you shouldn't have custody for whatever it was that you didn't do, but stand up to them. The court generally will prefer to give the kid to relatives, so just explain it to the judge. Don't let CYFD push you around.
