My niece has a kid they reside in NM when her son was born she didn't put a father on birth certificate and she put her own last name what are the chances of father getting custody in the future

This is a terrible question because you only provide the barest of information and then ask the broadest question imaginable. If your niece is a good mother and raises her child in the best way she can and is not neglectful, not an alcoholic or drug abuser, not a criminal, then she probably won't lose her child to the other parent. However, you said nothing in your question about the other parent except the man was not there for the birth and he has not yet (apparently) had his name placed on the child's birth certificate. If the child is 6 months old - that's not a big deal. If the child is 10 years old I suggest that the chances of him getting custody in the future are not real high. Your niece can consult with an attorney in your town. A consultation would allow her to provide very specific information to an attorney and she could get very specific answers to various aspects of the broad question you asked.
