Legal Question in Family Law in New Mexico
Parternity Test
I have a friend who's son had a baby with a girl who at times claims the baby is his and sometimes she claims it is not his. She will not get the child a paternity test she keeps making up excuses. The young man is getting very attached to the baby. What can he do? What rights does he have?

Re: Parternity Test
The man can go to court and file a petition to determine paternity and serve the mother. He can allege that he beleives he is the father but is not sure and he can request DNA examination. The court will order the mother, child and man to participate in DNA examination to determine whether he is the father.
In a non-legal setting the mother and alleged father could agree to take a DNA examination on their own (with the child) and see what that test shows. There are plenty of places that do DNA testing now a days and the cost is quite reasonable. The test consists of running a cotton swab over the inside of the person's cheek (in their mouth)and then mailing the kit to the lab and in about 4 to 6 weeks the results are returned. It's painless and accurate.
Once you all have determined whether he is the father or not then your next query will be to Dear Abby. :o)
