Legal Question in Family Law in New Mexico
I have primary custody of my two childern, ages 15 and 17. She took my childern out of state with out my permissiom. I know I could have filed kid napping charges on her but was the better preson about it.
My ex wife and I have made a verbal agreement concerning how we were going to manage expenses with our children and she is now not holding up to her side of the agreement. She was also to send me their grades every semister and did not follow threw with that also. How do I go about re-enforcing my legal rights and getting my childern back? She also she was going to the Attorney Genral in Texas. What should I do?

Your question is not sufficiently clear for the Guru to give you a clear answer. You did not say when she took the children. The second part of your question suggests that she did this more than 6 months ago. If that is correct then you have certain steps to perform. If it is not correct then you a different set of steps to perform. A strong point to always remember though is that verbal agreements are only as good as the paper they are written on. In the law, verbal agreements exist on shaky ground. You don't exactly loose with a verbal agreement but it can and does change the nature of how you try to prove something in court, if you get that far.
