retainer
if i give an lawyer a retainer and he does not use it all do i get the balance back

The general rule is that you signed a retainer agreement, or contract, for services of the attorney. If the contract said that your attorney would return any unused retainer fee then that is what should happen. Thus, the question that you must answer first, before your question to the guru can be answered is: what does your retainer agreement (or contract) with the attorney say?
