Legal Question in Family Law in New Mexico

im seeking sole custody of my daughter. her father has 3 dui's, attempt to commit a felony with a deadly weapon (attempted assault with a tire iron), showed up to her school which also happens to be my place of employment to have lunch with her and was intoxicated (they called the police and had him escorted from the property) and he has not been in contact with her since september '14. i waived my right to child support approximately 1 year ago as he was never able to pay it because he cannot maintain employment. to the best of my knowledge he remains unemployed and homeless.. i filed papers with the courts and nothing has happened and now i am planning to move to a different town in the same state at the end of may, and need to know how i can get the process moving along and how i can gain custody of my daughter and now get permission to relocate as well

The self help center in your judicial district can direct you which motion to file and the direction to follow.. You have a Deputy Court Executive Officer up there (home based at the Court in Aztec) who can put you on the right path. Give a call and you will likely have this matter resolved in a timely fashion.
