Legal Question in Family Law in New Mexico

My son lives in New Mexico with his mom. I have joint custody and visitation and live in Texas with my son's older brother and his two step siblings. My son has been in trouble with the law 3 times in a one year period. Twice for drugs and once for totaling his vehicle while driving drunk. He is sitting in juvenile hall right now and I honestly believe he should come live with me. His mom no longer can control him and seems to think he's an adult at 16. What can I do to have custody modified so he comes to live with me? Is there some kind of emergency affidavit I can file that would allow him to come to me immediately? It's nearly Christmas break so it would be nice if he could start school after the new year.
