Termination of Parental Rights

The legal father, he is not the biological father, lives in New Mexico, the child is 12 years old and lives in Texas with her grandparents and has since the day she was born. The child would like for the grandparents to adopt her but the legal father won't sign termination paperwork because he hates them. What is the residency requirements to file for involuntary termination of parental rights in New Mexico, the adoption would be filed in Texas. The mother will voluntarily sign termination paperwork in Texas. New Mexico laws are less strict and there is a provision that we think she would qualify for.
