Legal Question in Family Law in New Mexico

Trust forms for minor children

Our son passed away in Feb. leaving his estate to his children. He really had little to leave. He was in a divorce and excluded his wife from his will. We are trying to see whether to do a savings or set up a trust. This will involve attorney fees and felt these trust forms could be attained via internet.

Thank you.

Re: Trust forms for minor children

I am sorry for your loss. You cannot easily obtain the forms you seek from the internet. What I suspect would happen if you started buying forms here and there is that what you would get might need to be modified for your county. Or the form might be 'off' just enough that you may feel compelled to obtain another form - thus, you would be spending more money than you need to spend.

There are several issues involved when the divorce was pending and one of the parties has passed away. I would urge you to speak with an attorney who is versed in family law matters. Your son's attorney may be precluded from speaking with you about any of your sons' affairs.

You can look at some of my early answers to other questions about how to find an attorney but you can also call the State Bar of NM at eight hundred eight seven six six two two seven and ask for lawyer referral services; the state bar also has outreach, education and pro bono programs. What I want to be real clear about is that someone can help you on this matter and we just need to get you directed to the right person.

My personal email address comes with this answer and you are more than welcomed to send me an email.

Good luck
