Legal Question in Family Law in New Mexico
Unfair Judge
I had a court hearing today for custody for my son against my parents. They won cause his lived with them for 13yrs. but I never gave up my rights and I've been in his life But the reason I want him back is that I'm ready to take over but the judge gave them custody to them and gave me visitation only sundays from 2pm to 7pm and supervised by my parents in there home and we don't even talk cause were fight for my sons custody. I think thats unfair my lawyer tried fighting about the visitations but the judge said no. Also my lawyer asked for another hearing cause he wasn't prepared cause he had just recieved the papers that morning the day of the court so he didnt even know what to be prepare for and he told the judge and the judge said the hearing would still go on. I dont know what to do Help any suggestion please!!!

You're doing what you can. Judge is interested in the best interests of the child, and after the child has been in one home that long they're not likely to move them. It's about the child, not your rights or your interest. if you don't think your lawyer's doing a good job you can get another but it sounds to me like he's doing what he can. Best thing you could do is try to get on better terms with your parents so the visits become more pleasant and they may be willing to approach the judge with you for better visiting terms.
