Legal Question in Civil Litigation in New Mexico

Dangerous/Vicious Animal Liability

Hello! And Thank you!

My question is concerning liability of the owner of an animal running at large that goes on private property and kills another animal. The owner admittedly knew the animal was at large, acknowledges that his animal did kill the other animal, paid for the burial of the animal, and yet refuses to compensate the owners of the dead animal.

The animal at large was a Texas Longhorn bull and the animal killed was a 4 year old registered show horse.Thank You! John M.--name removed--III

Re: Dangerous/Vicious Animal Liability

Animal owners are generally responsible for the damages caused by their animals when the negligence of the owner allowed the animal to run at large. The key is in proving negligence on the part of the owner.

If negligence is there, then the resulting damages [the reasonable market value of the bull in your geographical area] are the responsibility of the negligent animal owner.

You will probably have to sue to get paid.
