Diminished value of car after accident

Hello,

I have a question with regard to diminished value claims. My wife was involved in an accident were she was hit a vehicle after it was hit by yet another. My wife was sitting idle at a stop light when this happened and both other drivers were cited for failure to yield. The insurance company has elected to repair my wifes car however they are using used part or ''like kind'' parts. I cannot find any information in New Mexico about diminished value nor do I know how to go about making a claim. My insurance company said I have to make the claim with Farmers who is both the other drivers insurer. I suspect that they will blow off my claim when I bring it up so were do I go from there? Are there attorneys in New Mexico that handle this or is this something I need to perform myself?

Your best bet is to file a collision claim under your own policy. Your deductible will apply, but your company will undoubtedly go to arbitration with Farmer's, and they can recover the deductible for you at that time. You are entitled to the retail cost of repairs less depreciation. That figure is usually calculated by a discount which the insured must pay to upgrade the parts to "new." It can also be reflected in the choice to use parts made by other than the automobile manufacturer, but you are not required to accept inferior, off-brand or non-OEM aftermarket parts. Insisting on new OEM parts will likely result in a cost to you above that which your company will pay. Most lawyers don't do this type of negotiating as it is not economic for the client. Fairness disputes over automobile repair may be litigated in Albuquerque in the Metropolitan Court under small claims jurisdiction.
