Legal Question in Immigration Law in New Mexico

my boyfrien entered the usa with a student visa he got a social security and everything when it came for his to renew they denied it and he stayed he got caught dwi and was arrested he spend a total of 20 days in jail . we got a lawer and he supposebly cleared his record if he was deported my boyfriend agreed he has been in mexico for 3 years now . Can he get a waiver so io may marry him and bring him back to usa legally or what do i need to do please tell me what i can do thank you.
