I filed a claim in April 07, i had water flowing under my foundation from the bathtub drain, i found the problem when i was getting ready to remodel the bathroom. This hidden leak has been going on for 5years. This was after spending alot of money over the years trying to eliminate foundation problem. The engineer they hired said the foundation settlement was due to normal soil settlement so as a result they declined my claim. I hired my own engineer and his report says otherwise! What do I do? Do I have a case?

Yes, but due to the length of time which has elapsed and the insurer's adoption of its expert's opinion, you should contact a lawyer familiar with property insurance issues. Most policies contain a limitations period, one or two years from the time a claim is denied, so you should consider taking action sooner rather than later.
