Legal Question in Intellectual Property in New Mexico

A professional photographer has posted a picture of my child on his website without my consent. A section of his website says "Some of the photos in the web galleries are for sale". It doesn't specify what photos are or are not for sale. Is there anything I can do? The person has not responded to any of my calls or email requesting information.

You can sue the photographer under the New York Civil Rights Law for invasion of privacy. And you should do so: these cases have been known to yield recoveries in the $30-$50,000 range, which would make a nice college fund.

The money will belong to the child, and will be held in an account subject to court approval until s/he is 18.
