County Government Personal Services Agreement

I have been selected to perform a personal services contract by a New Mexico county at a fixed price. The county manager has provided a VERY one sided contract; e.g., unlimited - time and dollars - indemnification of the county. It was apparently redacted from a standard form contract.

Rather than negotiate changes item by item, (the cost would be prohibitive given the value of the work specified), is there a standard form contract in use by New Mexico Counties under the personal service statutes? If so, how can a obtain a copy.

While this initial engagement with county government does not justify retention of counsel, I am relocating to central New Mexico, intend to build a consulting practice and am interested in establishing an on-going relationship with an attorney or firm.

I have no doubt you can find on the internet several standard personal service agreements for NM. Basically, personal service or consulting agreements and the laws governing them are fairly similar from state to state.

I would suggest you look carefully at the terms of the agreement and deal with the issues with which you are most concerned. If you are going to be in the consulting business it would be to your advantage to provide your own standard agreement, which has specific terms to reflect your needs and different kinds of services and clients for whom you intend to provide services.
