Legal Question in Employment Law in New Mexico
Too sick to work and boss chides
I have worked at the same office for 13 years as an office materials distributor. I now have severe foot and leg problems and can't continue to work as before; and my employer is chiding me for being a wimp and mama's boy. I have been a loyal and hard working employee. He's telling me he will not provide any compensation or disability assisstance and will not allow me to even make phone calls to my customers from the office. My brother has offered to help me distribute the materials to my customers, but the boss said no way. How can I obtain unempoyment benefits and/or disabilty benefits? I am a veteran so I never had health insurance via my job. I have rarely been absent and have never been late for work. I feel totally disrespected and disregarded by my boss's attitude towards me now! I offered to work a couple of hours a day which is more than my pain allows me to, but he just laughed and chided me and said if I was a real man, I'd just work without complaining. What should I do? How should I respond to him? Am I entitled to unemployment benefits or disability benefits? Please help me. I am single and have no dependents. My elderly parents are letting me stay at their home for now and I have never been reliant on them. Thank yo

Re: Too sick to work and boss chides
You need to engage a disability/employment law specialist in your community. If you email me your zip code I can help you locate one.
You have serious ADA and employment disability issues which need to be addressed. At a MINIMUM you would be entitled to UE benefits and your employer MAY have to accomodate your disability depending on # of employees and other factors.
Make sure you DOCUMENT statements by your employer and your medical visits and diagnoses.
