Legal Question in Landlord & Tenant Law in New Mexico
abuse of power by HOA Board
I belong to a Homeowner's Association with a Board of Directors that I believe is irresponsible and/or negligent in the course of its duties. They refuse to deal with violations to our CC&R's in manner prescribed in our documents. For example, with barking dogs they tell people to call Animal Control. I do not believe they have the right to do this. Because of their failure to enforce covenants I am being deprived of the right to enjoy my home & neighborhood. I have read all through our CC&R's and accompanying documents and can find nothing that authorizes the board to neglect these duties in such a way. Attempts to find what state law dictates have proven fruitless---I can find no mention of it in NM state law but admittedly may not be looking in the right places. Opinion please?
