Legal Question in Landlord & Tenant Law in New Mexico

my landlord, never gave me receipt for 3500.00 i gave to cover bills and rent. Ive been w/o hot water for 1.5 months now. Illegal on demand water heater mounted on wall is not ventailated for room, i also sleep in this room. The Gas Man said it releases 140,000 BTU, and im lucky im alive. Im still without hot water....and im pissed at my friend(owner) for almost accidently killiing me, what can i do.

If the situation is dangerous, it is inconceivable that NM Gas personnel would not "red tag" the premises and declare them unsafe for occupancy. You can (1) contact the city health department and have them inspect the premises, (2) contact NM Gas and ask them to do the same, (3) withhold future rent until the situation is rectified, and (4) file a Complaint in small claims court to recover the money you paid which was not used according to your agreement. You may wish to consider moving.
