Legal Question in Landlord & Tenant Law in New Mexico
After a lease has expired, when can a landlord remove tenants property and begin the cleanup process? We have a house in Taos, NM, and have returned to find it in total chaos, and nowhere near empty or clean, although the lease expired yesterday.

You may remove the tenants' property at any time, but you must safeguard it. You cannot just throw it out, you have to keep it in a reasonably safe place. You then go to court to get a judgment so you can sell the property or dispose of it in some reasonable manner. In Magistrate Court you can file the papers you need to file without a lawyer.
