Legal Question in Legal Ethics in New Mexico
Work Never Completed
Almost two years ago I won a Judgement against my Ex husband for past alimony. The judge ordered my lawyer to submit the written judgement to him for signing. I heard nothing more about the case until three months ago I located my Ex and went to the court house to look up my case and find the ''final'' judgement against my Ex. Low and behold it wasn't there! I went down to my lawyers office and the answer I received from him was ''the judge's secretary must have lost the paper work'' and ''please don't tell her I told you this since I have to work with her''. Then he told me I will have to start paying him $100 a month for past services and pay for the court transcript to be translated in order to ''refresh'' the Judge's mind on this case. The thing about that is my lawyer also won a judgement for all of his fees against my Ex. I don't feel like I owe my lawyer anything since I wasn't the one who didn't follow through with the judgement and he already won a separate judgement for legal fees. This can't be ethical or right, can it? What can I do since my lawyer won't return my repeted calls, nor can I receive a straight answer from his assistant?
