Legal Question in Personal Injury in New Mexico

I had a fall at work, breaking my left hip and right wrist. I am asking if a New Mexico private company has to abide by OSHA safety standards like public companies do. As this company I work for does not have any written safety standards, I was wondering if I had any legal rights against this company.

Determine if the company has worker's compensation insurance. If so, file a claim. If not, consult a personal injury attorney.
