Legal Question in Personal Injury in New Mexico
Injury from fall
While in New mexico I went on a horse back ride through the place where I was staying. Come to find out the saddle was not tight and let go with me on it. As I was falling I heard someone yell who saddled that horse. i took a hard fall on rocks and have a 40% fracture of the first vertibra. I now have a back brace and the doctor is hoping it will heal.I have written the company for help in medical and loss of wagesreimbursement but have heard nothing back. Am I entitled to anything?

Indeed you might have a case. Speak with an attorbney quickly to uncover any possible statute of limitations issues.

Re: Injury from fall
The hotel's insurance may have a medical pay provision in its insurance policy. This would pay your medical bills (up to the policy limit) regardless of whether anyone was negligent. In addition, you may be able to recover for your pain and suffering, lost income, and out-of-pocket expenses (such as un-reimbursed medical expenses) depending on whether the person who saddled the horse did it in a negligent manner. Whether you can sue in New York depends on whether the hotel does business in New York, which is an issue I would need to know a lot more facts before I could make a decision. Assuming you cannot sue in NY, you could always sue in the state the hotel is located, which I assume in New Mexico. My firm handles these cases on a contingency basis so please feel free to contact me if you wish to discuss your case.
